Terms of Service
Plain English, because you should be able to read what you are agreeing to.
Last updated 8 September 2026.
1. Who you are dealing with
Websites That Work, Gasthuisstraat 17, 1211 KB Hilversum, the Netherlands. Registered with the Dutch Chamber of Commerce under number 78309840. VAT number NL003316436B19.
You can reach us at hi@getwebsitesthatwork.com.
2. What these terms cover
These terms apply to the quote they came with, and to the work that follows from it.
Your own purchasing terms do not apply, unless we agree otherwise in writing.
3. The quote and agreeing to it
A quote is without obligation and valid until the date on it. An email saying you agree is enough for us to start. If you ask us to begin before you have agreed by email, that counts as agreement too. Paying the deposit through the link in your quote also counts as agreement.
The price is in the quote. Prices exclude VAT where it applies.
4. What we do
The quote sets out exactly what we build — how many pages, and which features. We build it to the best of our ability.
We promise a website we're proud to put our name on. We don't promise a particular number of visitors, inquiries, bookings, or sales, or a position in Google. Anyone who promises you that is guessing.
We start with a first design and show it to you. You tell us what you want changed and we change it, until you are happy and give the go-ahead. We deliberately do not cap the number of revision rounds — we want it to be right. What we do ask is that the number of changes stays reasonable.
Then we build the website to that design. If you want to change the design or the scope of the work, that is additional work and we will quote for it separately. You are always free to say no.
When the website is finished, we'll let you know. If we haven't heard from you within 14 days, including after a reminder, we treat the website as approved and the second half of the payment is due.
5. Timing
Any dates we give you are an estimate, not a binding deadline.
If things run late because text, images, access or your feedback arrive later than agreed, the delivery date moves with it.
6. What you provide
We write the text for your website and your emails. If you'd rather use your own text, for some or all of it, send it to us and we'll use yours.
You provide the photographs and logos, the answers we need to write your text, and the access we need to put the site live. Without those we can't start, and if they arrive late the delivery date moves with them.
Before your website goes live, you check all of the text, whether we wrote it or you did. Once you approve it, it's your responsibility: prices, opening hours, qualifications, and any claims about results.
If a first design already contains photographs or illustrations, those are examples to help you get going. Providing the actual images stays your responsibility.
7. Rights to text and images
By giving us text, photographs, logos or other material, you confirm that you are allowed to use it and to have it published on your website.
That includes the people who are recognizable in photographs: you make sure they have given permission. If there are children in them, you get permission from their parents or guardians.
If someone comes to us because material on your website infringes their rights — copyright, image rights, trademark or anything else — you carry the responsibility and the costs, including the costs of defending the claim.
8. Paying
You pay 50% when you agree, before we start building. When you pay it, you also authorize us to charge the remaining 50% and the monthly hosting to the same card or account.
We charge the remaining 50% on the day your website goes live, once you've approved it or it counts as approved (see article 4). The hosting is charged every month from that same day. If you pay with a different card or account later, we use that one from then on.
You receive your invoices digitally. We email you the invoices for the first and the second 50%. The invoices for your monthly hosting are in the Billing page of your website's admin, where you can download them at any time.
If a payment doesn't go through, we let you know and send you a link to pay. If it stays unpaid, we may stop work and, if we host your website, take it offline — only after telling you so in writing, at least 7 days in advance.
Once a payment is overdue, statutory commercial interest and collection costs are payable.
9. Delivery and checking it over
We deliver the website and put it live and working in the environment where it will run.
If something doesn't match what was agreed, tell us within fourteen days and we'll fix it.
If we hear nothing within fourteen days, or the website is already in use, the work counts as delivered.
10. Ownership
The website stays the property of Websites That Work until the invoice is paid in full. After that it's yours. Your domain name and your own content were always yours.
The systems and code we use to build and run websites stay the property of Websites That Work. You get the right to use them for your own website, and you keep that right — even if you move your website somewhere else.
The homepage we make for you is free, with no obligation. The design stays the property of Websites That Work. You can look at it and share it with your team, but you can't copy it or have someone else build it without hiring us.
11. Domain name and hosting
If we register your domain name, we put it in your name and it stays yours.
If your domain name is registered with us, we cooperate with moving it and give you the authorization code you need to transfer it.
If you take hosting from Websites That Work, the cost of the domain name is included, among other things. What the hosting costs and what else comes with it is in the quote.
If you arrange hosting yourself, the hosting and domain name costs are yours.
If we host your website, we make sure it's online. We can't guarantee uninterrupted availability — no hosting provider can. If something isn't working, let us know and we'll pick it up.
If there's something on your website that isn't allowed — content that is illegal, that infringes someone else's rights, or that harms others, such as spam or malware — we may take the website offline. The same applies if your website endangers the security of our systems or of other websites.
We'll tell you what's going on and give you the chance to fix it. Only if it really can't wait do we take the site offline straight away. If you don't fix it, we may end the hosting immediately.
Hosting runs by the month. You can cancel it any month. We can also end the hosting without giving reasons, with two months' notice, so you have plenty of time to move your website elsewhere.
If we end the hosting, your website simply stays online until the last day. On request you'll get a copy of your website and your database, so you can take everything with you.
Your automatic emails are part of the hosting and stop when it ends. You get their texts, so you can use them elsewhere.
12. Third-party services
For parts of your website we use services from third parties, for example for payments, email, hosting or forms. Those services are subject to the terms and rates of those companies themselves.
We are not liable for outages, changes or price increases at those companies.
13. What you arrange yourself
You are responsible for whatever the law requires on or around your website, such as correct prices and product information, your own terms and conditions, the right of withdrawal if you run a webshop, and your privacy statement.
We build the website so you can record and display these. Their content and accuracy stay your responsibility.
14. Liability
If something goes wrong and it is our fault, our liability is limited to the amount you have paid us for building the website. If we host your website, our liability for damage connected to the hosting is limited to the hosting costs of the past year. We are not liable for lost revenue or lost business.
We are not liable for damage caused by material you supplied, or by changes you or anyone else makes to the website after delivery.
What the law does not allow us to limit, we do not limit: this limitation does not apply in cases of intent or deliberate recklessness on our part.
A claim lapses if you do not report it to us within twelve months.
15. Circumstances beyond our control
If we can't deliver because of circumstances beyond our control — a supplier outage, or the internet going down — the arrangements shift. This also covers long-term illness or absence on our side. If it lasts longer than two months, either of us may end the work, and you only pay for what has already been done.
16. Confidentiality and personal data
What we learn about your business during the work, we keep to ourselves.
If we host or maintain your website, we process personal data for you while doing so. How we do that is set out in the annex at the end of these terms. That annex is our data processing agreement and applies alongside these terms. We never sell data on.
17. Credit and portfolio
The footer of the website carries a short note that the site was made by Websites That Work. If you would rather it wasn't there, let us know and we'll take it out.
We may show the website in our portfolio and in our own work, unless we agree otherwise.
18. Ending the work
If you end the work before the website is finished, we charge for the work done up to that point, with a minimum of the first instalment of 50%. That instalment covers the time we set aside for you.
Once the remaining amount is paid, you get everything that has been made of your website so far.
What you don't get is the systems and code we use to build websites, as set out in article 10. You may keep using them for your own website, including if you host it somewhere else.
19. Which law applies
Dutch law applies to our quotes and to our work. If we can't resolve something together, the dispute goes to the competent court in the Netherlands.
Annex — processing of personal data
This annex belongs to the terms above and is our data processing agreement. If you agree to the quote, this annex applies too. It takes effect when we can access your data, for example because we host or maintain your website.
Read the data processing agreement.
